Who We Are and What We Do
The Organization of Phonogram Producers of Serbia (OFPS) is a collective management organization for the related rights of phonogram producers, established in accordance with the Law on Copyright and Related Rights (Official Gazette of the Republic of Serbia, Nos. 104/2009, 99/2011, 119/2012, 29/2016 – Constitutional Court Decision, and 66/2019) and the Law on Associations (Official Gazette of the Republic of Serbia, Nos. 51/2009, 99/2011 – other laws, and 44/2018 – other law). OFPS carries out its activities based on an authorization issued by the Intellectual Property Office of the Republic of Serbia.
Pursuant to the Law, phonogram producers are entitled to remuneration for the broadcasting and rebroadcasting of phonograms, the public performance of phonograms, and the public performance of broadcast phonograms. Any person or entity that publicly performs or broadcasts phonograms (music) is required to pay remuneration to the phonogram producer. In order to ensure more effective protection of their rights, phonogram producers in Serbia established OFPS to collectively represent and protect their interests.
Our mission is to collectively manage the rights of phonogram producers by collecting remuneration for the use of music and distributing those royalties to phonogram producers.
Music is a form of intellectual creation. In order to be reproduced and copied, it must first be fixed on a sound recording medium (such as a CD, cassette, or other medium) or made available to the public via the Internet. Phonogram producers invest their own resources and organize the recording of music, reproduce phonograms, and make them available to the public, enabling all of us to enjoy the songs of our favorite performers.
Whenever someone’s property is used, remuneration must be paid. The rights of phonogram producers constitute a form of property, namely intellectual property. The use of another person’s intellectual property likewise requires payment of remuneration.
